The Argus in Brighton is appealing against the decision by Brighton Magistrates Court to restrict its reporting on a teenager who was given an anti-social behaviour order yesterday.
The paper named the teenager from Hove, who was given an Asbo barring him from the city centre at night, and described him as a member of a gang which it had reported on in the past.
But the court barred the paper from printing the 15-year-old’s picture, citing fears that he might be attacked or abused if members of the public recognise him.
The court’s stance is contrary to Home Office guidance from 2005, the paper argues in its report today.
Simon Westrop, head of legal for the Argus’s parent company Newsquest told the paper that he believes the order to be unlawful and that if necessary, the company would consider its right of judicial review by the High Court.
