Actor Ewan McGregor has won a High Court privacy action over photos of him playing with his children on a private beach which appeared in The Sun and the Daily Record.
French picture agency Eliot Press SARL did not appear in court for the case which concerned pictures taken in Mauritius last December.
The judge ruled in favour of McGregor, calling for damages to be assessed for breach of confidence and compensation made under the Data Protection Act. He could also call for all copies of the photos to be destroyed.
Solicitor Mark Thomson from Peter Carter-Ruck and Partners said: “The Press Complaints Commission has said many times that just because children have famous parents it doesn’t mean they can have their privacy invaded. Ewan and his wife are very keen to keep their children out of the public eye.
“Ewan issued a statement through his lawyer two years ago saying, ‘I may be fair game but leave my children alone’.”
