The Sun, the Daily Mirror and the Wigan Evening Post have escaped prosecution after they broke a reporting restriction made under section 39 of the Children and Young Persons’ Act during the Gary Newlove murder case.
PA’s Media Lawyer reports that Mr Justice Andrew Smith sitting at Chester Crown Court called all three papers to a hearing yesterday to explain why the order had been breached.
The order related to a defendent, Jordan Cunliffe, 16, and the fact he suffered from a disibility. The Sun revealed this, the Evening Post published his address, which was covered by the order and the Mirror published a picture of Newlove’s teenage daughter that had not not been cleared by the judge.
Sun editor Rebekah Wade personally wrote to the judge to explain what happened and included a copy of a memo sent to all Sun journalists on court reporting.
