Nottingham freelance photographer Alan Lodge's trial for obstructing a police officer has been adjourned until 5 March next year.
Lodge, who in March was arrested and had his camera confiscated when taking photographs of armed police response unit, was given unconditional bail.
The case was adjourned because Lodge's defence team had not been given access to a memory stick containing around 50 shots taken during the incident which they claim are critical sources of evidence.
The Crown Prosecution Service has 21 days to give the defence access to the memory stick or to provide legal arguments for not doing so.
It is likely the defence will argue that the NUJ and Nottingham Police had recently agreed guidelines stating that police have no right to arrest someone for taking photographs.
